The Florida State Statute 741.28 defines domestic violence as, “any assault, aggravated assault, battery, aggravated battery, sexual assault, sexual battery, stalking, aggravated stalking, kidnapping, false imprisonment, or any criminal offense resulting in physical injury or death of one family or household member by another family or household member.”

The state of Florida also recognizes that domestic violence can occur between two partners in a romantic relationship. The state will issue an injunction, also known as a restraining order, if the victim feels threatened by the offender. If the defendant violates that injunction, the state has every right to prosecute in the victim’s defense.

Florida state residents can request injunctions through the family courts. It can be a criminal or civil case depending on the severity.

You’ll need to file an injunction as soon as possible if you are worried about your safety. If you choose to file an injunction, it will be effective throughout your domestic violence case. With a second time offender, you’re looking at a felony with up to five years in prison. If he or she has a firearm or a concealed weapon’s permit, those rights will both be revoked.

However, if this is the offender’s first time committing a crime, the punishment will not be as severe. It’s all on a case-by-case basis, so we will need all of the information you have to accurately assess your domestic violence case.
